SB23-109: Criminal Penalty Controlled Substance Supplier

Last year's Fentanyl Bill included a penalty for drug dealers whose poison caused an overdose death. Because that bill was limited to fentanyl, around half of overdose victims and their families were left without justice.

More dangerous drugs are on their way to Colorado. The East Coast is seeing overdoses from drugs like Protonitazene and ISO's; both more powerful than fentanyl but not covered by Colorado's current law.

This bill would hold the supplier accountable by giving them a criminal penalty when a person dies as a result of the use of a controlled substance. It adds a sentence enhancer to the crime of "Distribution of a Controlled Substance".
